Terms & Conditions

1. Legal Information and Purpose

These Terms and Conditions (T&Cs) govern the contractual relationship between Fox & Heather (represented by Anaïs Dussart operating in a personal capacity), based in Edinburgh, Scotland (full postal address provided upon request or on invoices), hereinafter referred to as the "Service Provider", and any non-professional individual subscribing to its services, hereinafter referred to as the "Client".

Fox & Heather provides tailor-made travel planning, consulting, and itinerary optimisation services for travel in Scotland to individual clients. Any order implies full acceptance of these T&Cs by the Client.

2. Rates

The prices for the services are as follows:

Prices are expressed in British Pounds (£ / GBP) and include all applicable taxes. Any currency conversion fees or international banking charges remain the sole responsibility of the Client.

Last-Minute Requests: For any travel planning requested less than 30 days prior to the departure date, a fixed surcharge of £50 will apply to cover expedited processing.

The invoiced price corresponds exclusively to the consulting service and the creation of the personalised itinerary. It does not include any accommodation, transport, meals, entrance tickets, activities, or other travel services, which are paid directly by the Client to the respective third-party providers.

The consulting fee does not guarantee the availability of recommended services, nor does it guarantee that prices or conditions will remain unchanged after the itinerary has been sent.

3. Nature of Services (Exclusion of Booking Services)

3.1. Fox & Heather acts exclusively as a travel consultant and custom itinerary designer for Scotland. Services include research, selection of information, and presentation of recommendations regarding sightseeing, activities, accommodation, restaurants, transport, and travel experiences; the creation of proposed itineraries; and the delivery of a personalised travel guide.

3.2. Travel Agency Exclusion: Fox & Heather is not a travel agency nor a tour operator. The contract entered into between the Client and the business strictly concerns consulting and planning services, remunerated by a fixed price agreed in advance.

As such, Fox & Heather:

3.3. The Client makes all bookings and payments directly and under their own responsibility with third-party providers via the links or advice provided in the proposals.

4. Purchasing Terms

Fox & Heather offers custom travel planning and consulting services for Scotland aimed at individual travellers (excluding direct booking and sales of travel services).

4.1. Ordering Process

Step 1 – Contact & Questionnaire: The Client provides Fox & Heather with all necessary information to design the trip (email address, number and ages of travellers, desired dates or travel period, budget). Any incomplete request cannot be processed. Requests submitted less than 30 days prior to departure are subject to the last-minute fee outlined in Section 2.

Step 2 – Discovery Consultation & Deposit: Following the discovery consultation (by phone or video call), Fox & Heather sends a summary email to the Client containing these T&Cs and payment details. Payment of a 30% deposit definitively confirms the order and initiates the creation of the custom itinerary.

Step 3 – Delivery of Travel Proposal: Fox & Heather sends a detailed proposal including suggestions for flights, accommodation and transport within 10 working days of receipt of the deposit. These recommendations are provided for informational purposes only, based on rates and availability on the day of issuance. The Client is advised to book these services as soon as possible to secure availability and rates.

Step 4 – Adjustments & Modifications: The service includes up to two rounds of adjustments to the initial proposal. Any subsequent or substantial modification may be subject to additional charges.

Step 5 – Remaining Balance & Final Delivery: The remaining balance, representing 70% of the total amount of the service, becomes due upon confirmation of the bookings by the Client. Full payment of this balance is a mandatory prerequisite for the delivery of the custom Roadbook.

4.2. Payment Terms & Late Payments

Payments are processed via a secure payment link. Any delay in payment may result in the suspension of the service or a delay in the delivery of travel documents.

5. Right to Cancel and Cancellation

5.1. Right to cancel: In accordance with the UK Consumer Contracts Regulations, the Client has the right to cancel the contract within 14 days of its conclusion (the date the deposit is paid), without giving any reason.

5.2. Starting work during the cancellation period: By paying the deposit, the Client expressly requests that Fox & Heather begins work immediately, before the end of the 14-day cancellation period. The Client acknowledges that, if they cancel within this period, they must pay for the work carried out up to the date of cancellation, and that the right to cancel is lost once the service has been fully performed.

5.3. The deposit: The 30% deposit covers the research and creation of the travel proposal (Steps 2 and 3).

5.4. Cancellation after payment of the balance: If the Client cancels after paying the balance but before the Roadbook has been delivered, the balance is refunded, minus an amount proportionate to the work already carried out on the Roadbook. Once the Roadbook has been delivered, no refund is due.

5.5. How to cancel: The Client may cancel by emailing hello@foxandheather.com. Any refund will be made within 14 days, using the original payment method.

5.6. Cancellation by the Service Provider: If Fox & Heather is unable to perform the service, including because of events beyond its reasonable control (such as serious illness, severe weather, strikes or government restrictions), all sums paid will be refunded in full to the Client, excluding any further compensation.

6. Limitation of Liability

6.1. Relations with Third-Party Providers: The itinerary contains direct links to the websites of independent service providers (accommodations, transport companies, airlines, guides, etc.) to allow the Client to view their offers and make their own bookings.

These links are provided for informational and practical convenience only. The Client freely selects the services they wish to book and enters into direct contracts with the relevant third-party providers. The Client is responsible for verifying prices, availability, schedules, booking conditions, cancellation policies, access conditions, and other relevant information before making any commitment.

Fox & Heather accepts no liability for disputes, cancellations, over-bookings, price changes, bankruptcies, poor performance, or other issues attributable to third-party providers, nor for the consequences of events beyond its control occurring before or during the trip.

The terms and conditions of each third-party provider apply exclusively to the Client. Fox & Heather’s service concludes upon delivery of the agreed items. It does not include concierge services, booking management, emergency assistance, or operational support during the trip.

6.2. Travel Disruptions & Unforeseen Events: Fox & Heather cannot be held responsible for any issues during the trip resulting from events beyond its control, including but not limited to:

6.3. Administrative Formalities, Visas (ETA), and Insurance: The Client is solely responsible for fulfilling all administrative and health formalities required to enter the United Kingdom (valid passport, obtaining an ETA - Electronic Travel Authorisation or visa where applicable), as well as driving requirements (valid driving license).

Fox & Heather shall not be held liable for entry refusal, missing documentation, or delays in obtaining an ETA/visa attributable to the Client or UK border authorities.

The Client is also solely responsible for securing all necessary travel insurance (cancellation, repatriation, medical assistance, personal liability).

6.4. Limit of liability: Nothing in these Terms excludes or limits Fox & Heather’s liability for death or personal injury caused by its negligence, for fraud, or for anything else that cannot be excluded or limited by law. Subject to this, Fox & Heather’s total liability to the Client in connection with the service is limited to the total fees paid by the Client for that service.

7. Intellectual Property

All documents provided by Fox & Heather (itineraries, customised proposals, maps, travel guides) are protected by copyright. They are intended strictly for the Client’s personal and private use. Any reproduction, distribution, resale, or commercial exploitation without the prior written consent of Fox & Heather is strictly prohibited.

8. Personal Data Protection (UK GDPR)

Collected personal data is required for travel planning and client relationship management in accordance with UK data protection legislation (UK GDPR / Data Protection Act 2018). Personal data is never sold. How it is used, which providers process it on Fox & Heather’s behalf, and how long it is kept are set out in the Privacy Notice. The Client may exercise their rights to access, rectify, or delete their data by emailing: hello@foxandheather.com.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with Scots Law. In the event of a dispute, an amicable solution will be sought prior to any legal action. Failing an amicable agreement, the Scottish Courts shall have exclusive jurisdiction.
